The grievor sought reimbursement of real estate and legal fees as specified in FSD 16, for the sale of his wife's principal residence.

The Administrative Committee considered and agreed with the report of the Foreign Service Directives Committee in that it was noted that the grievor's spouse had not resided with him in Ottawa prior to his assignment to Paris, and the residence in question was the residence in Thunder Bay which the grievor's wife occupied prior to her marriage and relocation to Paris. FSD 16.05 provides for reimbursement of real estate and legal fees involved in the sale of a principal residence in the employee's headquarters city. As the residence in question did not meet the definition of a principal residence, and was not located in the employee's headquarters city, it was agreed that the employee had been treated within the intent of the Directive.

The grievance was denied.
