FSD 25 Deficiency adjustment

The grievor sought a retroactive accommodation deficiency adjustment for the period the grievor occupied staff quarters.

The grievor occupied staff quarters and sought the deficiency adjustment for a period when construction was taking place in the vicinity. The housing committee visited the quarters two years after the grievor took occupancy, the level of construction had been considerably reduced at that time however there was no doubt that the construction of the apartment building located next to the quarters started when the grievor took occupancy.

The Executive Committee considered and agreed with the report of the Foreign Service Directives Committee in that the grievor was not treated within the intent of the Foreign Service Directives and that an ADA equivalent to 15 % be authorized from July 1991 to March 1993, the period prior to the housing committee inspection.

To the extent that the above satisfies the corrective action sought the grievance was upheld.
