The grievor sought that he be permitted to utilize FSD 45 credits earned prior to June 1, 1993 in conformity with the provisions of FSD 45, paragraph 45.04 (c) in effect at the time the credits were earned.

The employee, a foreign service employee, serving in Europe, applied on May 24, 1993 for permission to trade in ten days of foreign service leave, in accordance with FSD 45 paragraph 45.04 (c), for the purpose of undertaking a trip to Japan with his family for the period of mid-September to the end of September 1993. The following day, departmental representatives responded to the employee's request, stating that the request was premature in that it was a well established departmental financial practice not to authorize travel and/or issue accountable advances prior to 60 days from to the commencement of the trip.

The Executive Committee noted that the Foreign Service Directives Committee had reached an impasse. The Executive Committee could come to no agreement.
