The grievor sought action under Articles 84, 85 and 92 of the Canadian Labour Code.

The Administrative Committee noted that Section 7.1.3 of the NJC By-Laws reads as follows:

"An employee who feels that he/she has been treated unjustly or considers himself/herself aggrieved by the interpretation or application by the Employer of any directive, policy or regulation which has been the subject of NJC consultation and adoption, and which has been approved by the appropriate executive body of the government is entitled to present a grievance."

The Administrative Committee agreed that as the Canada Labour Code is not a matter within Section 7.1.3, they lacked jurisdiction to render a decision.
