The grievor sought reimbursement of funds expended as a result of an early termination of posting.
The grievor had completed an assignment at one post and was offered a cross-posting to another. Prior to departing for the new posting the grievor sold his car and, as well, incurred certain costs which he considered he would not have incurred had he not accepted the cross-posting. Those costs included clothing purchases and dental work, both expenses undertaken following a review of post report recommendations.
The grievor's assignment to the new post was cancelled shortly after his arrival at post, and the employee returned to .Canada approximately one year after his arrival.
The Administrative Committee considered and agreed with the report of the Foreign Service Directives Committee in that the grievor had been treated within the intent of the directives, and that neither FSD 3.07 nor FSD 3.09 applied in his case.
The grievance was denied. However, the Administrative Committee further agreed with the recommendation of the Foreign Service Directives Committee that the department determine with the grievor the amount of his actual losses, if any, from the early termination of his posting, and make every reasonable effort to obtain compensation for him through a submission of the President of the Treasury Board.
