The grievors sought reversal of a decision which reverted Tokyo to an A level post effective January 1, 1991, and/or grandfathering of benefits under FSD 58 until the completion of the posting.
Tokyo became a Level 1 hardship post in July 1988. The post was advised that once there were improvements to the office accommodation, there would not be sufficient points to warrant a hardship rating and Tokyo would once again become a Level A post. After a review by the Hardship Posts Committee (HPC) in December 1990 and the resulting decrease in point totals, Tokyo reverted to an A Level post effective January 1, 1991. As of that date, the grievor no longer received a post differential allowance. The grievor accepted the posting to Tokyo on the basis that he would receive a post differential allowance and would either earn or maintain the 50% increase provided under FSD 58.07 for continuous service at this post or at others prior to posting and possibly after.
The Administrative Committee noted that the Foreign Service Directives Committee reported that there was no evidence that indicated a violation of article 58.07. The Administrative Committee considered and agreed with the report of the Foreign Service Directives Committee that the grievors had been treated within the intent of the directive.
The grievances were denied.
