The grievor sought waiver of shelter cost for the period from July l to July 8, 1989.
In February 1989 the employee received a Posting Confirmation Form indicating an expected date of departure from the post abroad to Ottawa of July l, 1989. The grievor made arrangements to occupy his house in Ottawa effective July l, 1989. The grievor's replacement did not arrive at the post abroad until July 8, 1989.
The Administrative Committee considered and agreed with the report of the Foreign Service Directives Committee in that despite the fact that circumstances such as this were not envisaged when FSD 25.09(c) was introduced, the specific wording of the section would permit the grievor's claim and therefore the grievor was not treated within the intent of the Directive.
The grievance was upheld.
