The grievor sought that the employer apply Treasury Board Procedure 4-9 (Withdrawal from Work) and that management bring in a safety officer from Labour Canada to investigate the situation.

The grievor, on two separate occasions, early in March 1985, had refused to perform duties utilizing chainsaws. The grievor was suspended and eventually dismissed by the employer in regard to the incidents. The grievor filed grievances in regard to the suspension and dismissal at the time the incidents took place. The above grievance was not filed until the last week in May 1985.

The Administrative Committee considered the report of the General Secretary and agreed that the grievance was untimely.
