The grievor sought that the application and interpretation of the Policy on protective footwear be sufficiently broad to allow the provision free of charge of protective footwear where there was a requirement for that footwear in the performance of an employee's duties.
The Administrative Committee considered and agreed with the report of the Occupational Safety, Health and Physical Working Conditions Committee in that the department had met the intent of the Policy in identifying positions requiring protective footwear and had further acted in accordance with the requirements of the Clothing Policy.
The Administrative Committee further noted that the NJC grievance process could not be used to change a Policy and that employees should understand changes to the Policy were made during triennial reviews following input of both sides.
Therefore, the grievors' proper route for changing policy was through the bargaining agent and that the departmental route as for changing policy was through the Official Side of the Council.
The grievance was denied.
