The grievor sought that the department withdraw a job offer, extend the surplus period and continue attempting to find a position.

The grievor, a year after being declared surplus from a position in a work unit that was relocated, was offered the exact same position in the new location. The department relocated the work headquarters to another city; however the actual work performed was never performed at the work headquarters. Employees lived in various locations across Canada, and were not asked to relocate as a result of the work relocation.

The Executive Committee considered and agreed with the report of the Work Force Adjustment Committee in that the grievor was treated within the intent of the directive. The report noted the unique situation in regard to actual location and nature of the work performed, the almost complete absence of work in the new location of the office in this case and that the majority of the work performed is on a ship or on a plane and is not done in the old or the new location.

The grievance was denied.
