The grievor sought that the employer fully comply with the provisions of the Work Force Adjustment directive.
The grievor was given a job offer a much lower position than the position from which the grievor had been declared surplus. The question was raised as to whether the offer should have been made and the priority rights of the grievor should the position be accepted.
The Executive Committee considered and agreed with the report of the Work Force Adjustment Committee in that the grievor was treated within the intent of the directive. The Executive Committee further noted that the report advised that the Public Service Commission regulations preventing this employee from being formally marketed to other departments, at his former professional group and level, resulted in a financial loss to the employer and a source of frustration to the grievor.
The grievance was denied.
