The grievor sought payment of education allowance under FSD 34. The employee's spouse and son had remained in London during the employee's posting to Algiers.
The Administrative Committee agreed with the report of the Foreign Service Directives Committee that given the specific wording of FSD 34.02, the employee had been treated within the intent of the Directive.
However, the Administrative Committee further agreed with the report in that there were exceptional circumstances which would warrant a submission to the President of the Treasury Board as provided for in FSD 34.02(d) and that a representative of the relevant bargaining agent would be given an opportunity to review the draft prepared by the department requesting the submission.
The grievance was denied.
