Background
The employee grieved the Employer's refusal to reimburse relocation expenses.
Executive Committee Decision
The Executive Committee considered the information provided in this case and agreed that the employee was not entitled to the reimbursement of relocation expenses. It was noted that the employee's relocation took place during an assignment period and was completed before the offer of an indeterminate position was accepted. It also noted that neither the letter of offer for the assignment nor the letter of offer for the indeterminate position made reference to relocation assistance.
The Executive Committee also considered the issue of timeliness and agreed that the employee moved in December 2007 and did not seek reimbursement of relocation expenses until December 2009. As such, the grievance was dismissed for lack of jurisdiction and moreover was deemed untimely.
