Background
The grievor, an employee in City A, Province G, had filed a harassment complaint in October 2016. The Department put measures into place to separate the parties and the grievor requested to be moved to another unit within the City A office. After one (1) day in this temporary unit, the grievor requested to be moved specifically to the City B regional office, which the Department was able to provide.
The grievor temporarily worked out of the City B regional office until November 3, 2017. It should be noted that the temporary office was closer to the grievor’s home.
On December 10, 2018, the grievor submitted travel and mileage expense claims for the periods of time that they worked at the City B regional office. The total claims amount for mileage and meals is $28,336.58. Following the denial of the claim, the grievor submitted their grievance on January 7, 2019.
The grievor’s permanent workplace to temporary workplace is a 30 km drive; their permanent workplace to their residence is a 130 km drive; and their temporary workplace to their residence is a 109 km drive.
Grievance
The employee is grieving management’s decision to deny their claim for the travel expenses incurred from November 2016 to November 2017 when they were ordered to work at the City B office by their Employer following their submission of harassment and violence in the workplace complaint.
Executive Committee Decision
The Executive Committee considered the circumstances and arguments with respect to timeliness concerning this grievance. The Executive Committee agreed that the grievance is untimely. As such the grievance is dismissed.
