Background

The grievors, at the time of the event, had their designated work location as the Federal Training Center (FTC) at Location A, City G, Province M. Due to operational issues at the FTC, they were immediately assigned to the Location B, also in City G. The distance between the two locations is 1.6 km.

The grievors effectively began their assignments on their respective start dates at the FTC. Their assignments were both initially scheduled to end on June 30, 2012; however, they were both subsequently extended until December 31, 2012. The assignment agreements do not indicate if the grievors were subject to travel entitlements. No travel claims were submitted with respect to the assignment periods, nor do the grievors have relocation files.

Grievance

The employees are grieving the Employer's refusal to pay the amounts to which they were entitled to under the Travel Directive, or the Relocation Directive, when their duly signed letters of offer were rescinded. Though permanently appointed to the FTC, on the start date provided for in their respective offer letters, the grievors were reassigned to Location B on a temporary basis.

The grievors claim that they had to postpone their relocation, and travel from their respective residences (Grievor 1 from City H, Province M and Grievor 2 from City J, Province M) to Location B, resulting in the grievors being on travel status until the temporary assignments ended.

The grievors have suffered the following other inconveniences: temporary housing, travel, stress, meals and others.

It is noted that there were ongoing discussions in attempt to resolve these grievances. It was only once the Employer confirmed via email to the Bargaining Agent on May 25, 2018, that the discussions would cease unless a grievance was formally presented. Therefore, these grievances were subsequently filed.

Executive Committee Decision

The Executive Committee considered the circumstances and arguments with respect to timeliness concerning these grievances. The Executive Committee agreed that the grievances are untimely. As such the grievances are dismissed.
