Background

The grievor was working in the City M, Province N, away from the grievor’s substantive position at City O, Province N. The grievor did not submit travel claims for mileage, meals, or incidental allowances during this time. The Employer alleges that the grievor was on assignment and not on authorized travel status.

The grievor had a conversation with two colleagues who suggested they should have been on travel status and therefore was entitled to mileage and meals during their time in City M. The grievor submitted a travel claim, requesting that meals and mileage be reimbursed. The claim was rejected by management as untimely and unreasonable. The grievor subsequently filed their grievance.

Grievance

The employee is grieving that the Employer has violated the NJC Travel Directive (the “Directive”) by denying their travel status mileage allowances. 

Executive Committee Decision

The Executive Committee considered the circumstances and arguments with respect to timeliness and agreed the matter is untimely. The grievance was filed 11 years after the events giving rise to the dispute. As such the grievance was dismissed.
