Commuting Assistance – Timeliness

The Department notified employees of the results of a study on December 14, 2001 in regard to suitable residential community within 16 km of the workplace.  As a result of the study no commuting assistance was recommended for the Institution. The grievor claimed that he did not become aware of the results of the study until March 28, 2002, as such, filed a grievance on April 2, 2007.

Executive Committee Decision

The Executive Committee considered arguments of the Department and bargaining agent in regard to timeliness in this case.  Since the grievance was submitted three and a half months after receipt of the official notification the parties agreed that the grievance was untimely.
