The grievor sought issue of protective clothing and protective footwear.

The grievor's duties involve being in travel status for long periods of time assisting in the tests on petroleum delivery metering devices. The work involves carrying hoses, etc., and the grievor is exposed to fumes and splashes.

The Administrative Committee considered and agreed with the report of the Occupational Safety and Health Committee which advised as follows:

The Committee noted that the grievor had been provided with safety boots subsequent to the grievance being filed and that the bargaining agent agreed that the action satisfied the grievance in regard to safety footwear.

The Committee agreed that the matter should be referred to the local JOSH committee with specific direction to carefully consider the following:

(1) Oil refinery personnel give careful consideration to this type of situation, and the JOSH committee should consult with refinery representatives.

(2) Whether clean-up facilities are available at these testing locations.

(3) The work schedule should be considered in determining the quantity of issued clothing. Going away for two weeks with two pairs of coveralls may not be adequate.

(4) In providing protective clothing fit, comfort, maximum protection and quantity sufficient for anticipated needs must all be considered.

(5) The committee is to be involved in the selection of protective clothing.

The Administrative Committee further agreed that the department be asked to report as to the actions of the JOSH committee and that report be reviewed by the Occupational Safety and Health Committee.

To the extent that the above meets the corrective action sought the grievance was denied.
