The grievor stated that the requirement to wear a hard hat at all time while at work applied to certain employees and not to others in the same area or environment. The grievor sought that this type of discrimination cease.
The Administrative Committee considered the report of the Occupational Safety and Health
Committee and noted that the Committee agreed that as the grievor's particular unit was subject to the same safety policy, the Occupational Safety and Health Committee was at a loss to understand how the treatment could be considered discriminatory. It was also noted that the Occupational Safety and Health Committee found that the departmental policy generally respected the standard; however the policy was not fully explained to the JOSH Committee.
The Administrative Committee agreed with the report of the Occupational Safety and Health Committee in that the grievor had been treated within the intent of the Policy and further agreed to the Occupational Safety and Health Committee suggestion that the department's attention be drawn to Standard 3-20 in regard to the explanation of the Policy.
The grievance was denied.
